Terms of Use – Agreement.
Myclublink.com LLP (“Myclublink”, “we”, the “site”) operates Myclublink.com, the online community for active people. We provide lots ways (“services”) for helping users meet people they share similar interests with and allow clubs and organisations to build and grow their membership bases. By accessing or using our website at www.Myclublink.com you (the "User", “Member” “Club”) signify that you have read, understood and agreed to be bound by these Terms of Use ("Terms of Use" or "Agreement"), whether or not you are registered with Myclublink.com. At our sole discretion, we reserve the right to change, modify, add, or delete parts of these Terms of Use at any time without further notice. If you continue to use Myclublink.com after any such changes, this constitutes your acceptance of the new Terms of Use. If you do not agree to abide by these or any future Terms of Use, do not use or access the Site. It is the responsibility of the User to check for changes in the Terms of Use, however we will strive to notify all Users of changes to these Terms. If you wish to become a User and communicate with other users please read these Terms of Use and indicate your acceptance of them by following the instructions on the registration page.
Eligibility
Registration and use of Myclublink.com is void where prohibited. Only Users who are thirteen (13) years of age and older may use this site. Registration by anyone that is under the age of 13 is unauthorised and in violation of the Terms of Use. Users will have their membership terminated if they violate any terms within this Agreement. By using the Site you are signifying that you are 13 or older and agree to abide by all the Terms of Use within this Agreement.
Registration
When registering to use Myclublink.com Users are responsible for entering accurate and complete information where required. Users must maintain the security of their password and identification at all times and update their personal information as and when required. Users are also responsible for any use and actions taken on behalf of their registration details submitted.
Term
All Terms of Use will remain in full force while the User accesses and uses Myclublink.com. Users are permitted to terminate their membership at any time and for any reason and all personal information submitted by the User will also be terminated. Myclublink may terminate any membership at any time and for any reason without prior notification or explanation, and without liability.
Proprietary Rights for Myclublink
All content within Myclublink.com including designs, health information, general information, text and graphics and the arrangement of this content within the Site are the proprietary property of Myclublink.com LLP. No content may be copied, distributed, republished, modified, downloaded or sold in any form or by any means. Only legal information posted by the User in their personal profiles may be used out with the site. Any other use of the site content including gathering and extracting data is strictly prohibited and will result in termination of membership.
Fees and Charges
Myclublink reserves the right to change its fees (if any) for different aspects of the site without prior notice from time to time. If Myclublink terminates a membership the user will not be entitled to any refund of fees or payments (if any) unless agreed to by the Site.
Non Commercial use by Users
Myclublink.com may not be used by Users in connection with any commercial or marketing endeavours unless they are endorsed or authorised by the Site. Illegal and/or unauthorised use of the website by Users including email collection, collecting content information by any means, use of electronic methods or any other means for the purposes of sending unsolicited emails and unauthorised framing of or linking to the website will be dealt with swiftly and may result in legal action being taken, including without limitation, civil, criminal, and injunction redress.
Club Information
On Myclublink, Users are allowed to set up club/organisation profile pages that allow other members to join and interact with the club/organisation and people associated with the club/organisation. By creating a profile, clubs may be able to stabilise their core membership base by allowing their members to become more involved with club/organisation activities. Clubs many also be able to self promote and grow their membership base. While any User is permitted to set up a club/organisation profile We strongly advise that Users seek the authorisation of the club/organisation before creating a profile unless they already possess the authorisation. Myclublink takes no responsibility for unauthorised club/organisation creation on the Site and cannot be held liable for any content, accuracy and/or opinions made about any club/organisation on the Site. It is the sole responsibility of the User that created the club/organisation to control what information is submitted about the profile created. Please see the Content Posted, Conduct and Use of Site by Users for more information about the roles and responsibilities of Users on Myclublink. If there is a disputed club/organisation profile where authorisation for the creation of the profile has not been granted by the club/organisation in question then the club/organisation may contact the Site administration to log the complaint and the Site administration will look at the dispute and act accordingly. Myclublink reserves the right to cancel any club/organisation profile at any time if We deem the profile to be unauthorised by the club/organisation in question. Furthermore, Myclublink reserves the right to remove and replace any User from administering any club/organisation profile at any time and without prior notification. Trading Marks
Myclublink.com and all logos, designs, page headers, button icons and names, scripts and service and application names are copyright and design right protected and are the property of the Site and are marks or designs used as trading marks of the Site in the UK and/or other countries. None of the aforementioned may be used, copied, imitated or sold in whole or in part by any user or third party without the permission of the site. Legal action may be taken if these terms are broken.
Content Posted, Conduct and Use of Site by Users
The use of Myclublink and the services We provide is for the benefit of our Users. Users are allowed to promote their own clubs and services through the appropriate channels within the Site. Direct commercial activity by Users on the Site is only permitted when authorised by the Site. Myclublink reserves the right to remove any commercial content at its sole discretion if it is not authorised by the Site. Commercial advertisements, affiliate links, and other forms of unauthorized solicitation may be removed from Member profiles without notice or explanation and may result in termination of Membership privileges. Myclublink reserves the right to take appropriate action for any illegal use of the Site and Services. Apart from advertising their services through the appropriate channels within Myclublink, Users may use our services for their personal, non-commercial use only. You represent, warrant and agree that no materials of any kind submitted through your account or otherwise posted, transmitted, or shared by You on or through the Service will violate or infringe upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary rights; or contain libelous, defamatory or otherwise unlawful material. In addition, Users of the Site and Site Services must not:
Myclublink reserves the right to take action against anyone who violates any of these terms, including without limitation, removing the offending communications from the site where appropriate and terminating the membership of such violators. Even though such use is strictly prohibited, there is a small chance that you might become exposed to such items and You further waive your right to any damages (from any party) related to such exposure.
You are solely responsible for the photos, profiles (including your name, image, and likeness), messages, notes, text, information, music, video, advertisements, listings, and other content that You upload, publish or display (hereinafter, "post") on or through the Service or the Site, or transmit to or share with other Users (collectively the "User Content"). You may not post, transmit, or share User Content on the Site or Service that you did not create or that you do not have permission to post. Myclublink reserves the right to remove, reject, refuse to post or delete any Content for any or no reason. You may remove your User Content from the Site at any time. We have the right to terminate the membership of any User that infringes on these terms. If however, You believe that your work has been copied and used in an unsolicited way please provide us with the following information:
An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; a description of the copyrighted work that you claim has been infringed; a description of where the material that you claim is infringing is located on the website; your address, telephone number, and email address; a written statement by you that you have, in good faith, a belief that the disputed use is not authorized by the copyright owner, its agent, or the law; a statement by You, made under penalty of perjury, that the above information in your notice is accurate and that You are the copyright owner or are authorised to act on the copyright owner's behalf. Member Disputes
You are solely responsible for your interactions with other Myclublink Users. We reserve the right, but have no obligation, to monitor disputes between You and other Users.
Limitation on Liability
In no event will Myclublink.com LLP or its Partners, employees or agents be liable to You or any third party for any indirect, consequential, exemplary, incidental, special or punitive damages, including lost profits arising from your use of the Site, even if the Site has been notified of the possibilities of such damages. Notwithstanding anything to the contrary contained herein, myclublink’s liability to You for any cause whatsoever and regardless of the action, will at all times be limited to the amount paid, if any, by You to Myclublink for the services during your term of membership.
Disclaimer
Myclublink is not responsible or liable for any information or content posted on the Site by any User or third party applications and/or software. We do not control and are not responsible for what Users post, transmit or share on the Site and are not responsible for any offensive, inappropriate, obscene, unlawful or otherwise objectionable content You may encounter on the Site or in connection with any User content or third party applications, software or content. Myclublink assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of User communications. We are not responsible for any technical malfunction including failure of emails of notification, traffic congestion on the internet, computer failure, telephone or telephone network failure, software failure and/or technical problems or a combination thereof, including injury or damage to User's or to any other person's computer, mobile phone, or other hardware or software related to or resulting from using or downloading materials in connection with the web and/or in connection with the Service, including any third party software. Under no circumstances will Myclublink be responsible for any loss or damage, including any loss or damage to any User content or personal injury or death as a result of using the Site or its Services whether online or not. Myclublink is not responsible for the content, accuracy or opinions expressed on any third party websites, and such websites are not necessarily investigated, monitored or checked for accuracy or completeness by Myclublink. Inclusion of any such website does not imply that we endorse or approve any third party websites. If a User enters such a website they do so at their own risk. We take no responsibility for third party advertisements or applications posted, nor do we take any responsibilities for goods and services provided by these advertisers.
Termination
Myclublink may terminate User memberships, delete User profiles and delete any information posted on the site for any reason, or no reason, at any time at its sole discretion, with or without notice. If a User dies and we are notified we will generally, but are not obliged to, terminate the membership.
Disputes
All disputes shall be governed by the laws of Scotland. You and Myclublink agree to submit to the exclusive jurisdiction of the courts located within Scotland to resolve any dispute arising out of the Terms of Use or the services provided without regard for principles or conflicts of laws within Scotland. The law of the land will govern the Terms of Use and any dispute. Therefore, you agree to not commence or prosecute any action in connection with a dispute out with the laws of Scotland and you hereby consent to, and waive all defence of lack of personal jurisdiction and forum non convenience with respect to, venue and jurisdiction in the courts of Scotland.
Indemnity
You agree to indemnify and hold Myclublink, its subsidiaries, affiliates, officers, agents and other partners and employees harmless from any loss, liability, claim, or demand, including reasonable solicitors fees, made by any third party due to or arising from your use of the Myclublink Site and Services in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representation and warranties set forth in this Agreement and/or if any content that You post on or through the Site causes Myclublink to be liable to another.
Other
This Agreement is accepted upon your use of the Myclublink Site or any of the Myclublink Services and is affirmed by You becoming a User of the Site. The Terms of Use constitute the Agreement between You and Myclublink regarding the use of the Site. Any failure of Myclublink to enforce any provision or right of these Terms of Use shall not constitute as any waiver of such provisions or rights. The titles within the Terms of Use are for convenience sake only and have no legal or contractual effect. Myclublink and Myclublink.com is a trading mark of Myclublink.com LLP and these Terms of Use operate to the fullest extent, the laws that govern Scotland. If any Term of Use is unlawful, void or unenforceable, that Term is deemed severable from this Agreement and does not affect the validity and enforceability of any remaining provisions.
